Terms of Service

1. Acceptance of Terms

By accessing and using firstfan's services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Use License

Permission is granted to temporarily access the materials (information or software) on firstfan's platform for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

• Modify or copy the materials
• Use the materials for any commercial purpose or for any public display
• Attempt to reverse engineer any software contained on firstfan's platform
• Remove any copyright or other proprietary notations from the materials

3. Artist Obligations

Artists using firstfan's platform agree to provide exclusive merchandise drops to verified Day 1 fans as specified in their campaign agreements. Artists are responsible for ensuring the authenticity and quality of design for merchandise offered through the platform.

4. Fan Verification

Fans seeking verification as Day 1 supporters must provide authentic proof of early support, including but not limited to concert tickets, merchandise receipts, playlist screenshots, or other documentation. firstfan, in conjunction with the artist's team, reserves the right to verify and approve or reject any submission at its sole discretion.

5. Payment Terms

All payments processed through firstfan are subject to our payment processing terms. Artists will receive payment according to the agreed-upon schedule after deducting platform fees and payment processing costs. All sales are final unless otherwise specified.

6. Intellectual Property

The service and its original content, features, and functionality are and will remain the exclusive property of firstfan and its licensors. Artists retain all rights to their content and intellectual property while granting firstfan a license to use such content for platform operations.

7. Termination

We may terminate or suspend access to our service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. All provisions of the Terms which by their nature should survive termination shall survive termination.

8. Limitation of Liability

In no event shall firstfan, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
