Terms of Service

1. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you may only use the Service with the involvement and consent of a parent or legal guardian.

2. Your Account

To participate in a campaign or purchase a drop, you may need to create an account and provide accurate, current information. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

3. Day 1 Fan Verification

To be verified as a "Day 1" fan for a given artist or campaign, you may be asked to submit proof of early support — such as concert tickets, receipts, screenshots, or other documentation. By submitting materials for verification, you confirm that the materials are authentic and belong to you.

firstfan, in some cases together with the partnering artist's team, reserves the right to approve, reject, or request additional information for any verification submission, at our sole discretion.

If your submission is verified, certain information (including your name, city, and proof submission) is shared with the partnering artist's team as a standard part of the verification service. Please see our Privacy Policy for full details on what information is shared, with whom, and how you can control marketing communications from a partnering artist.

4. Purchases

When you purchase merchandise or other items through a campaign, you agree to provide accurate payment and shipping information. All sales are final unless otherwise stated for a specific campaign. Pricing, availability, and eligibility for any drop are set by firstfan and the partnering artist and may change or end at any time.

firstfan is responsible for coordinating fulfillment (production, shipping, and delivery) for items purchased through the Service unless otherwise noted for a specific campaign.

If an item you receive is defective, damaged, or materially different from what was described, or if your order is lost in transit, please contact us at info@firstfan.app so we can investigate and, where appropriate, arrange a replacement or refund.

5. Acceptable Use

When using the Service, you agree not to:

• Submit false, fraudulent, or misleading information or documentation
• Attempt to circumvent or manipulate the verification process
• Use the Service for any unlawful purpose
• Attempt to reverse engineer, copy, or interfere with the Service's software or infrastructure
• Resell or transfer verified Day 1 status or access rights obtained through the Service

6. Intellectual Property

The Service, including its design, software, and platform content, is the property of firstfan and its licensors. Artist names, logos, and merchandise designs remain the property of the respective artists. You may not use any of this material outside of your personal use of the Service without permission.

If you submit content to the Service (such as verification materials, photos, or comments), you grant firstfan a non-exclusive, worldwide, royalty-free license to use, store, and display that content for the purpose of operating the Service, including sharing your verification submission with a partnering artist's team as described in our Privacy Policy.

7. Termination

We may suspend or terminate your access to the Service at any time, for any reason, including if we believe you have violated these Terms.

8. Disclaimers and Limitation of Liability

The Service is provided "as is" without warranties of any kind. To the fullest extent permitted by law, firstfan is not liable for indirect, incidental, special, or consequential damages arising from your use of the Service, including issues related to fulfillment delays, verification decisions, or third-party artist content.

9. Indemnification

You agree to indemnify and hold firstfan, its officers, employees, and partners harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or any content or documentation you submit, including fraudulent or inaccurate verification materials.

10. Dispute Resolution and Arbitration

Please read this section carefully — it affects your legal rights.

You and firstfan agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved through binding individual arbitration, rather than in court, except that either party may bring an individual claim in small claims court if it qualifies.

Class Action Waiver. You and firstfan agree that disputes will be brought only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding.

Arbitration Procedure. Arbitration will be conducted by a neutral arbitrator through a recognized arbitration provider (e.g., the American Arbitration Association), under its rules then in effect, on an individual basis. The arbitrator's decision will be final and binding, subject to limited review under applicable law.

Opt-Out. You may opt out of this arbitration agreement by sending written notice to info@firstfan.app within 30 days of first accepting these Terms. If you opt out, disputes will be resolved in accordance with Section 11 (Governing Law) below.

11. Governing Law

These Terms are governed by the laws of the United States and the State of California, without regard to conflict of law principles.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide notice (such as posting an update on this page) before the changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
